This Privacy Policy describes how GiftedTalented.com, operated by GiftedTalented LLC, a Delaware limited liability company (“GT,” “we,” “us,” or “our”), collects, uses, discloses, and protects information when you use our website, services, programs, and related properties (collectively, the “Services”).

GiftedTalented.com operates a family of independent brands and properties referred to in this Policy as the “GiftedTalented.com Network,” described in Section 3.3 below.

By using the Services, you agree to the terms of this Privacy Policy. If you do not agree, do not use the Services.

1. Information We Collect

We collect the following categories of information:

1.1 Information You Provide Directly

  • Name, email, phone number, and contact information
  • Date of birth, location, school affiliation, and educational background
  • Photographs, videos, audio recordings, and written submissions
  • Profile information, social media handles, and online presence details
  • Application materials, nomination submissions, and program-related content
  • Communications with us, including emails, form submissions, and survey responses
  • Payment information for paid services (processed by third-party payment providers)

  • Usage data (pages visited, time spent, click patterns, referring sources)
  • Cookies, pixels, web beacons, and similar tracking technologies
  • Location information derived from IP address

1.3 Information from Third Parties

  • Information from nominators, schools, partners, and referral sources

(b) Reviewing applications, nominations, and program participation

(e) Marketing, promotion, and audience development for GT and Network brands

(f) Cross-program identification, recruitment, and community-building across the GiftedTalented.com Network

(g) Research, analytics, and product development

(h) Legal compliance, fraud prevention, and protection of GT’s rights

(i) Any other purpose disclosed at the time of collection or with consent where required

3. How We Share Information

We may share information with:

3.1 Service Providers

Third-party vendors who perform services on our behalf, including hosting, analytics, email delivery, payment processing, customer support, and content distribution.

3.2 Editorial and Media Partners

Publications, podcasts, press, and content distributors in connection with editorial coverage of GT programs and honorees, subject to applicable consents.

3.3 The GiftedTalented.com Network

GiftedTalented LLC operates a family of independent brands and properties under common ownership and editorial direction, collectively referred to as the “GiftedTalented.com Network.” Network properties include:

  • GiftedTalented.com (the flagship platform)
  • Unicorn Parents
  • Other brands, sub-brands, programs, properties, and platforms launched, acquired, or developed by GiftedTalented LLC, whether existing as of the effective date of this Policy or formed thereafter

We share personal information across the GiftedTalented.com Network for purposes consistent with this Policy, including editorial coverage, program operations, event invitations, community-building, recruitment into other Network programs, and Network-wide communications. Each Network property is governed by privacy standards substantially similar to those described in this Policy.

You acknowledge that participation in any GT program or use of any Network property may result in your information being shared across the Network, and that ongoing communications, opportunities, and program invitations may originate from any Network brand. Your consent to this Policy constitutes consent to such Network-wide sharing.

The GiftedTalented.com Network is independent and operates separately from any other organizations, ventures, or affiliations of GiftedTalented LLC’s founders, members, or operators. Information collected through GT is not shared with external organizations except as expressly described in this Policy.

3.4 Business Transfers

In connection with any merger, acquisition, financing, reorganization, or sale of assets of GiftedTalented LLC or any Network property, we may transfer the operation of the Services and the personal information held in connection with the Services to a successor entity. Such transfer shall not require new acceptance of this Policy, and the rights and obligations described herein shall continue under the successor entity.

Government authorities, courts, or other parties when required by law, subpoena, court order, or to protect the rights, property, or safety of GT, our users, or others.

Other parties when you direct us to share or consent to sharing.

3.7 Aggregated and De-Identified Data

We may share aggregated, anonymized, or de-identified information for any purpose without restriction.

4. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent.

For program participants who are minors (under 18), we require parent or legal guardian consent before processing personal information for editorial, promotional, or program-related purposes. Parents and guardians may review, modify, or request deletion of their child’s information by contacting david@giftedtalented.com.

We comply with the Children’s Online Privacy Protection Act (COPPA) and other applicable children’s privacy laws.

5. Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies to operate the Services, analyze usage, personalize content, and support advertising and marketing. You may control cookies through your browser settings, though disabling cookies may affect Service functionality.

We may use third-party analytics and advertising services, including Google Analytics, Meta Pixel, and similar tools. These services have their own privacy policies governing their use of data.

Depending on your jurisdiction, you may have rights including:

Requests will be coordinated across the GiftedTalented.com Network where data has been shared. We may retain limited data where required by law, for legitimate business purposes, or where data has been anonymized.

7. Regional Provisions

7.1 California Residents (CCPA/CPRA)

California residents have rights to know, delete, correct, and opt out of the sale or sharing of personal information. We do not sell personal information for monetary consideration. Sharing of personal information among GiftedTalented.com Network properties, as described in Section 3.3, is conducted under common ownership and editorial direction and is not considered a “sale” under applicable law.

7.2 EU/UK Residents (GDPR)

Our legal bases for processing include consent, contract performance, legitimate interests, and legal obligation. EU/UK residents have rights under GDPR including access, rectification, erasure, restriction, portability, and objection. Cross-property data sharing within the GiftedTalented.com Network is conducted under legitimate interest and consent bases.

7.3 Korean Residents (PIPA)

We process personal information in accordance with the Personal Information Protection Act. Korean residents may exercise rights of access, correction, deletion, and processing suspension.

7.4 Vietnamese Residents (PDPD)

We comply with Decree 13/2023/ND-CP on Personal Data Protection.

7.5 Other Jurisdictions

We comply with applicable privacy laws in jurisdictions where we operate.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by data type and purpose. Information shared across the GiftedTalented.com Network may be retained by Network properties under their own retention practices. Editorial materials and published content may be retained indefinitely as part of GT’s archive.

9. Data Security

We implement reasonable technical and organizational measures to protect personal information. However, no system is completely secure, and we cannot guarantee absolute security. You use the Services at your own risk.

10. International Transfers

GT operates internationally, and personal information may be transferred to, stored in, and processed in countries other than your country of residence, including the United States, South Korea, Vietnam, and Singapore. By using the Services, you consent to such transfers. Where required, we implement appropriate safeguards including standard contractual clauses.

The Services may contain links to third-party websites, services, and content. We are not responsible for the privacy practices of third parties. Review their privacy policies before providing information.

12. Changes to This Policy

We may update this Policy at any time, including to reflect new Network properties, expanded data practices, or changes in applicable law. Material changes will be communicated by posting the updated Policy on the Services with a revised “Last Updated” date. Continued use of the Services after changes constitutes acceptance of the updated Policy.

13. Disclaimer and Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFTEDTALENTED LLC AND ALL GIFTEDTALENTED.COM NETWORK PROPERTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE TOTAL AGGREGATE LIABILITY OF GIFTEDTALENTED LLC AND ALL GIFTEDTALENTED.COM NETWORK PROPERTIES ARISING FROM OR RELATED TO THIS POLICY OR THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT PAID BY YOU TO GT IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

14. Governing Law and Disputes

This Policy is governed by the laws of the State of Delaware, without regard to conflict of law principles. Disputes shall be resolved in the courts of Delaware, or at GT’s election, through binding individual arbitration. Class actions and class arbitrations are waived to the maximum extent permitted by law.
